MONTREAL — An Ontario woman has been fined $14,000 after being found guilty of libelling a commercial dog breeder online.
Ontario Superior Court Judge Michael Galligan heard last week that Lorie Gordon of Brockville, Ont., made the comments about the poor health of her black Labrador retrievers on an Internet pet forum.
The judge ordered Gordon to pay $10,000 in damages and $4,000 in court costs to James, Charlene and Nicole Labombard, the owners of the Shawville, Que.-based Paws R Us Kennel.
Galligan ruled the comments Gordon posted online between July 2004 and April 2005 at Pet information - dog information - cat information - Canada's pet information center for dogs cats and humans and another popular pet websites were defamatory.
But Gordon said on Monday she will appeal the decision with the help of donations from animal-rights advocates.
"I wrote they had sick dogs, which is true," she said.
Luc Barrick, the Ottawa lawyer representing the Labombards, said Gordon and several other witnesses, including representatives from Montreal's SPCA, attempted to portray Paws R Us as a puppy mill.
"They are trying to say a commercial breeder is a puppy mill and they are not," Barrick said. "There are puppy mills out there but my client is not one of them."
Alanna Devine, director of animal welfare at the Montreal SPCA, said she was disappointed that the judge ruled against Gordon.
Hundreds of puppy mills exist across Quebec and limited legislation makes it difficult for inspectors to shut down the operations, she said.
Marko Kulik, one of the owners of the Montreal-based website http://www.pets.ca where Gordon posted the online comments, said he was shocked by the decision. __________________ Karen K.

Nicole Labombard and her mother Charlene agreed to give up ownership of the dogs taken from their property in September. Humane Society International raided the Clarendon farm, seizing more than 500 dogs living in deplorable conditions. In exchage of the guilty plea, the former owners do not have pay the sheltering costs incurred. Officials with HSI Canada say it cost $6,000 per day. A judge ruled the Labombard family, which operated the puppy mill, will lose custody of 607 dogs and have to pay a fine. The dogs, and more than a hundred puppies born since the seizure now belong to the Quebec government and can be adopted out. The decision was met with screams of surprise and delight by animal welfare advocates who were in court in Campbell's Bay, Quebec.

| Whew! Good to know that the truth was discovered, the kennel was outed and all those dogs were saved a horrid future.
I still think it's worth noting, though, that libel suits, warranted or not, are sometimes taken seriously by the courts. __________________ Karen K.

I think the woman in the original articl;e should now sue, them and the judge, to get her monies back or at the very least appeal because she was telling the truth as proven by their guilty plea. Imagine pleading guilty and they get out of the costs associated with caring for 608 living things. how much did they care for them in the first place. UUUUUGGGGGHHH!!!!!!!!!!!!!!

This is so sad. How could any one family take care of 600 Animals? Poor babies!
Can you imagine the balls it takes for this family to sue Lorie Gordon when they were so grossly overwhelmed with the care of 600 animals?!?! __________________ Christin

I know of this kennel and they always have ads for multiple breeds in the paper. They are by every definition a puppy mill. __________________

I understand your point, Karen, but sometimes you just have to stand up for what you believe in. Several years ago a local breeder asked me to take and rehome his female who wouldn't get pregnant, telling me she was worthless if she couldn't produce and hinting that he would take her to the pound that day if I didn't get her out of his backyard asap. She was ill, emaciated and terrified of, well, everything. When I posted pictures of her on my website he threatened to sue me, stating his business of selling dogs would suffer if word got out about the condition his dogs were in. Since he didn't work otherwise, that was a big deal for him. I refused to remove her pictures and information and he sued me for libel, slander, loss of income and a few other things, stating no reputable breeders would deal with him after they heard the story of Tessa. I learned that this was one of almost a dozen lawsuits this man had filed against other people for various reasons. Once he found out that I had everything documented with vet records, pictures, etc he tried to drop the case. I decided not to let it drop because I believed his story needed to be puplic record. I won, of course, and he looked like an animal abusing, lying moron in court. It was a lot of hassle but last I heard this man was no longer breeding Mastiffs. My attorney told me that anyone can sue anyone for any reason, with or without concrete proof, and all the defendant can do is try and defend him/herself. I felt it was important enough this time to stand my ground and not let this dog's story be swept under the rug. I'm so glad the story you posted had a happy ending for the animals and hope the original ruling was overturned. __________________ Tina Clement

I, personnally, have a few friends that had some of these dogs in foster families for a few months. My friend Caroline had Havane, a Boxer, with teats touching the floor and, severe temperament issues due to the fact of living in a crate for all of her life. My friend Marie-Josée, got a Labrador Retriever bitch and, 3 3weeks old puppies also in foster family. Fortunately all of these 4 dogsgot rescaped, spayed/fixed are now placed in loving families. After having these 527 dogs seized (plus the puppies on the way), the lawyer now says that their customers really love dogs and, that the government is trying to use them as an example. Labombard and, her daughter are now trying to fight the law to have the right to start their business back (they lost their right for two years). So far, they got a 10 200$ fine . 600$ per mistreated dog. WHAT A SHAME!

Hi Everyone, Just wanted to let you know that I have not paid any money to this family, you don't pay until you have a chance to appeal. I have been waiting since July 2009 for my appeal and now I will tell you that some very exciting news is coming out May 17 2012, after 7 years in court this case will be over. Thank You to all the people who supported me through this case, I will never forgot the ones who stood beside me in court year and after. |

Thank you Lorie for standing your ground and speaking up regardless of the personal consequences. 7 years is a long court battle but it seems in the end you were right. Now let's hope the courts do not EVER allow these people dogs again. IMO they are just as bad as the dog fighting people. As they only value they put on the living things in their care is a dollar sign.

I made a promise to Blaze the last time I held him in my arms, I was going to keep that promise no matter how many years it took. It was a difficult path yes but I would do it all over again, I will always speak the truth and if that hurts someone oh well. I believe if anyone looked at their website which in no longer there but was while this case was in the papers and on TV and seen 87 different breeds of dog and reported over 400 dogs it would be clear that I was right, two stories where told in court but the Judge choose what he wanted to hear. |

I think we would all agree you did the right thing no matter HOW hard it was. Clearly, our judicial system doesn't always work. Also, unfortunately, many courts don't see "dog" cases as being important.
